Hawaii generally has 15 years from the date a tax is assessed to collect it by levy or a court proceeding. That’s five years longer than the IRS, which generally has 10 years.

The 15 years only start once the tax is assessed, and certain events pause the clock. If you never filed a return, there’s no deadline for Hawaii to assess the tax in the first place. How many years you need to file is a separate question from how long the State can collect.

So Hawaii state tax debt doesn’t simply go away after a few years.

Where the 15-Year Rule Comes From

The rule is in Hawaii’s tax statutes:

Both sections had a transition rule. For taxes assessed before July 1, 2009, collection was barred after June 30, 2024. Debts that old have generally expired.

Hawaii vs. the IRS at a Glance

Hawaii DOTAX IRS
Time to assess after a return is filed Generally 3 years (HRS §235-111(a), §237-40(a)) Generally 3 years (IRC §6501(a))
Time to assess if no return was filed No limit (HRS §235-111(c), §237-40(b)) No limit (IRC §6501(c)(3))
Time to collect after assessment 15 years 10 years (IRC §6502)
Refund claims Generally 3 years from filing or the due date, or 2 years from payment (HRS §235-111(b)) Generally 3 years from filing or 2 years from payment (IRC §6511)

When Does the Clock Start?

The 15 years start on the assessment date, not the year you earned the income or the date the return was due. A tax is usually assessed in one of three ways:

This is why unfiled returns are so risky. With no return, there’s no assessment, so the 15-year collection clock never starts. DOTAX can still assess those years at any time.

What Pauses (Suspends) the 15 Years?

Under both §235-111(a) and §237-40(a), the collection period is suspended while any of these apply:

  1. You agree to extend it. You sign an agreement to suspend the period.
  2. A court controls your assets. This covers proceedings in any federal or state court, such as bankruptcy, plus six months after.
  3. A Hawaii offer in compromise is pending.
  4. You’re out of the state for six months or more in a row. If the period would run out within six months of your return to Hawaii, it’s extended so it doesn’t expire until six months after you come back.
  5. You appeal the assessment to the Taxation Board of Review or the Tax Appeal Court. The pause runs from the date the notice of appeal is filed until a final decision, withdrawal or dismissal.

Rule 4 matters in Hawaii, where many people move to the mainland for work or family. Living away for years can add those years to how long the State can collect.

The IRS has its own separate rules for pausing its 10-year period. The two clocks almost never end on the same date, even for the same tax year.

What Hawaii Can Do During Those 15 Years

DOTAX’s own guidance warns that not dealing with taxes “can lead to serious consequences such as audits, garnishments, bank levies etc.” Hawaii has its own relief options. Over 15 years, interest also keeps adding up. Under HRS §231-39(b)(4), interest on unpaid Hawaii tax accrues at two-thirds of 1% a month, or 8% a year, so an old balance can grow well beyond the original tax.

Should You Wait It Out?

Usually not. Here’s why:

That said, knowing your exact collection dates does affect strategy. For a debt that’s close to expiring, a different approach may make sense than for one that was just assessed. A careful review of the State’s records shows exactly where each year stands.

Frequently Asked Questions

Does Hawaii tax debt expire?

Generally yes, 15 years after assessment, unless the period has been paused. Unfiled years have no deadline to be assessed.

Is Hawaii’s collection period longer than the IRS’s?

Yes. Hawaii generally has 15 years to collect after assessment. The IRS generally has 10.

Does moving off-island stop the clock?

It can pause it. The 15-year period is suspended while you’re outside Hawaii for a continuous period of at least six months.

Does the 15-year rule apply to GE tax?

Yes. HRS §237-40(a) uses the same 15-year collection rule and the same suspensions for General Excise Tax.
